All of the adversarial issues associated with a start-up company will be discussed including inventorship, employee, financial, co-inventor, investor, third party infringement, validity, trade secret theft as well as other seminar issues. The November SLW teleseminar presents a panel discussion about the Supreme Court hearing on obviousness, 35 U.S.C. §103. The case is KSR v. Teleflex and the issue concerns the teaching, suggestion, motivation test promulgated by the Federal Circuit. Information and briefs for the case are available at www.scotusblog.com. Our panel of highly experienced SLW practitioners will vigorously discuss the positions taken by the parties as well as those taken by the 20 amicus parties supporting the patent owner Teleflex and the 16 amicus parties supporting KSR. The panel will also discuss the KSR case history, the development of obviousness, the MPEP guidelines of the PTO and the recent change of view at the PTO. For the sake of an interesting presentation, the panel members will adopt and argue opposing points of view although these views should not be regarded as the views of SLW and its attorneys. The panel will present again to discuss the Supreme Court decision and its consequences once that decision is announced.
