Modern Induced Infringement: Evolving Standard Based on Recent Supreme Court Decisions

The U.S. Supreme Court has recently examined the induced infringement standard as it relates to “skinny labeling” of pharmaceuticals, first in Teva Pharmaceuticals USA, Inc. v. GlaxoSmithKline LLC (”GSK”) (2023) and recently in Hikma Pharmaceuticals USA Inc. v. Amarin Pharma, Inc (2026).  We will examine these outcomes and explore how these decisions may impact various industries involving the chemical arts.

John Swart prepares and prosecutes patents in several fields including electrical, biomedical, software, mechanical, and chemical technologies.  Additionally, John prepares Freedom to Operate opinions and manages portfolios for several small to mid-size clients, including counseling and diligence support for tech startups from conception to sale.

Dr. Nicholas P. Lanzatella has a Ph.D. in Organic Chemistry and a B.S. in Chemical Engineering, in addition to a law degree. Nicholas is a registered patent attorney whose work involves chemical engineering, materials science, and organic chemistry.
